BAKERSFIELD, Calif. - A probable cause arresting statement says John Giumarra III's blood alcohol level was 0.18 percent, more than twice the legal limit, when a test was administered following the a crash that killed a bicyclist in January.
Giumarra told police he thought he hit something in the roadway. The bicyclist, 32-year-old Angela Holder, later died.
District Attorney Lisa Green said insufficient evidence existed to charge Giumarra with felony DUI.
Giumarra entered a not guilty plea to felony hit-and-run.
