BAKERSFIELD, Calif. - Update: The Bakersfield Police Department will recommend to the Kern County District Attorney's Office that the suspected drunk driver involved in the fatal crash that killed Francisco Javier De La Cruz Sunday, be charged with murder.
Bonifacio Garcia, 27, and his passenger are recovering in an area hospital and both are expected to survive.
Garcia has one prior DUI conviction.
Update: The Kern County Coroner's Office released the name of the man who died in an alleged drunk driving crash over the weekend.
According to officials, 25-year-old Francisco Javier De La Cruz of Taft was hit by a suspected drunk driver on Taft Highway near Stine Road just after 10 a.m. Sunday. De La Cruz was air lifted to the hospital where he died from his injuries.
According to Bakersfield Police Officers, De La Cruz was driving a black pick-up truck near Stine Road when the driver of a silver Nissan traveling the opposite direction swerved into his lane, hitting him head on.
The driver and passenger in the Nissan have moderate injuries. Police haven't said if the driver of the Nissan will be arrested.
The car was seen drifting toward the other lane before hitting the truck, according to police.
BPD said they think alcohol may be a factor in this crash.
